Welcome to the website of Top Tier Tree LLC (“Top Tier Tree,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of www.toptiertreemn.com, including its content, forms, features, and other online services.
By accessing or using our website, you agree to these Terms. If you do not agree with these Terms, please discontinue use of the website.
These Terms apply primarily to the use of our website and online services. Tree care work performed by Top Tier Tree may be subject to separate estimates, proposals, contracts, work authorizations, payment terms, or other agreements. If a separate written agreement conflicts with these website Terms regarding services being performed, the terms of the applicable written service agreement will control.
1. About Top Tier Tree

Learning about promotions, services, or other offerings.
You agree not to misuse the website or interfere with its normal operation.
You may not knowingly:
Attempt to gain unauthorized access to the website or related systems;
Introduce malicious software, code, viruses, or other harmful material;
Use automated systems to excessively access or scrape the website;

Attempt to disrupt the security or availability of the website.
We reserve the right to restrict access to the website when reasonably necessary to protect Top Tier Tree, our customers, our systems, or other users.
3. Estimate and Contact Requests
Our website may allow you to submit a contact request or request an estimate for tree care services.
Submitting a form through our website does not create a contract, guarantee an appointment, guarantee service availability, or obligate Top Tier Tree to perform any work.
Information submitted through an estimate request is used to help us understand your needs and contact you regarding potential services.
We may need to inspect the property, trees, site conditions, access, hazards, or other factors before providing an estimate.
Any estimate, proposal, or pricing provided by Top Tier Tree may be subject to separate terms and conditions.
4. Estimates, Pricing, and Service Availability
Prices displayed or discussed generally on our website, advertisements, educational materials, or other marketing materials should not be considered a binding quote unless specifically identified as such.
Tree care pricing can depend on numerous site-specific factors, including tree size, condition, location, accessibility, equipment requirements, surrounding structures, hazards, disposal requirements, and the scope of requested work.
A price becomes applicable to a specific project only when provided through an authorized estimate, proposal, agreement, or other communication from Top Tier Tree.
Estimates may have expiration dates or other conditions as stated in the applicable estimate or proposal.
Submitting an estimate request does not reserve a place on our schedule.
Service availability and scheduling may vary based on workload, weather, emergencies, equipment availability, site conditions, and other operational circumstances.
5. Tree Care Information and Educational Content
Our website may contain information about trees, tree health, pruning, removal, pests, diseases, storm damage, planting, safety, and other tree-related subjects.
This content is provided for general educational and informational purposes only.
Trees and site conditions can vary substantially. Information provided on the website should not be considered a diagnosis or site-specific professional recommendation for a particular tree or property.
Photographs, symptoms, descriptions, articles, FAQs, and other online information cannot always establish the condition, structural integrity, disease status, or risk associated with a particular tree.
Where appropriate, an on-site inspection may be necessary before recommendations can be made.
6. Emergency Tree Situations
Information provided through our website regarding emergency or storm-damaged trees is intended for general informational purposes.
Submitting a website form does not guarantee immediate emergency response.
If a fallen or damaged tree has created an immediate threat to life, fire, electrical hazards, downed utility lines, or another public emergency, contact 911 or the appropriate utility/emergency authority first.
Do not approach or touch trees, limbs, equipment, fences, vehicles, or other objects that are contacting or located near downed electrical lines.
Top Tier Tree's ability to respond to an emergency depends on factors including location, weather, crew availability, equipment availability, site safety, and the nature of the emergency.
7. Scheduling and Weather
Tree care operations are affected by weather and environmental conditions.
Scheduled work may need to be postponed, rescheduled, interrupted, or modified because of:
Severe weather;
High winds;
Lightning;
Excessive rain;
Snow or ice;
Unsafe ground conditions;
Equipment issues;
Emergency storm response;
Site-access limitations; or
Other circumstances affecting safe operations.
Safety takes priority over maintaining a scheduled service date.
Specific scheduling and cancellation provisions applicable to a project may be contained in the customer's estimate, proposal, or service agreement.
8. Customer Responsibilities
Customers requesting service are responsible for providing accurate information regarding the property and requested work.
Depending on the project, customers may also be responsible for informing Top Tier Tree about known conditions that could affect the work, including:
Property boundaries;
Private underground utilities;
Irrigation systems;
Invisible/electric pet fencing;
Septic systems;
Drain fields;
Wells;
Private electrical lines;
Landscape lighting;
Underground structures;
Access restrictions; and
Other known property conditions that may not be readily visible.
Specific customer responsibilities associated with a tree care project may be described in the applicable estimate, proposal, or service agreement.
9. Property Ownership and Authorization
By requesting work on a property, you represent that you are the property owner or otherwise have appropriate authority to request the proposed work.
Top Tier Tree may request additional authorization when property ownership, property boundaries, rental arrangements, association requirements, neighboring trees, or other circumstances create uncertainty regarding who may authorize the work.
Customers are responsible for obtaining any permissions required from property owners, associations, neighbors, or other private parties unless otherwise agreed in writing.
10. Permits, Utilities, and Local Requirements
Tree removal, pruning, planting, land clearing, and related activities may be subject to local ordinances, permitting requirements, utility restrictions, protected-tree requirements, or other regulations.
Requirements vary by municipality and property.
Unless specifically stated otherwise in a written estimate or agreement, customers are responsible for identifying property-specific restrictions or permissions that apply to their property.
Top Tier Tree may assist with or obtain certain permits or utility-related coordination when included within the agreed scope of work.
11. Payments
Top Tier Tree may accept payment through methods including:
Cash;
Check;
Venmo; and
Credit or debit card through QuickBooks or another authorized payment processor.
Available payment methods may change.
Electronic transactions may be processed through third-party payment providers and may also be subject to those providers' terms and privacy policies.
Payment schedules, deposits, due dates, late-payment provisions, fees, and other project-specific payment terms will be stated in the applicable estimate, invoice, proposal, or service agreement when applicable.

Top Tier Tree may photograph trees, vegetation, property conditions, work areas, equipment access, or completed work for legitimate business purposes, including estimating, planning, documentation, safety, quality control, training, and recordkeeping.
Certain photographs may also be used for educational or promotional purposes when appropriate.
